Helen Davis Chaitman coined the term “lender liability” and has been involved in some of the seminal decisions defining the obligations of financial institutions - particularly in the area of good faith and fair dealing. She has written the monthly newsletter Lender Liability Law Report since 1987. Ms. Chaitman is a Partner at Becker & Poliakoff LLP and a nationally recognized expert in the area of bank litigation. In her career, Ms. Chaitman has been ranked among the nation’s top ten litigators by the National Law Journal for a jury verdict she obtained in an accountant’s malpractice case. Ms. Chaitman has successfully handled all kinds of bank litigation. She has prosecuted and defended RICO claims on behalf of banks; defended banks in claims for breach of contract, conversion, and fraud; represented borrowers against banks on claims for breach of contract and fraud; represented banks and borrowers in suits involving guaranties of corporate debt; counseled banks in bankruptcy proceedings and in litigation against the Office of the Comptroller of the Currency. Ms. Chaitman has also represented several corporate debtors in Chapter 11 cases that were successfully reorganized, and she has a diverse litigation practice including RICO litigation, professional malpractice litigation, New York City statutory residency litigation, bankruptcy litigation, bank fraud litigation, and white collar defense.
